Through the excessive and unnecessary criminalization of some offenses, today the US uses a highly discriminative and stratified incarceration system to advance racial oppression, especially against the black population.
Aim
The goal of writing this paper is to demonstrate how the United States incarceration system operates discriminatorily against the minority. Using statistical and literary review, the study will indicate how the fight against drug abuse contributes to racially discriminative incarceration. There is mass prejudice against the minority and crime and the in particular black population. This report will illuminate the social-economic, political and structural factors that predispose the black people to an unfair judicial system to the reader and thus explain their large numbers in correctional facilities. By doing this, the paper also aims to help detention facilities incorporate correctional value to the current purely punitive system.
Audience
This article is relevant to every person who has interests in uncovering the underlying structural factors in the US Justice System that are racially discriminative. This is especially important for any individual who has the genuine concern about the disproportionate racial presentation in the detention facilities. It is especially relevant to policymakers who are liable to ensuring a fair trial and equal rights to every American citizen. Subject Matter
This study’s thesis leads the writer to establish statistics and trends in the incarceration system. There is an analysis of the past social-economic, structural and political events in America that resulted in the current state. This is because these factors influence the probability that an individual will end up in a correctional facility. Such events as Slavery and Jim Crow subjected black people to a financial and material disadvantage that makes them prone to poverty even today. As a result, significant populations of them reside in low-income neighborhoods that are prone to crime, drug trafficking, and use. This substantially increases their chance to crime and drug-related offenses. Additionally, the poor financial status disadvantages them in representation during the trial.
Organizational Plan
This research will first identify past events that put black people and a social-economic disadvantage when compared to their white counterparts. It will then demonstrate the role of these obstacles to increased chances of ending up in an incarceration system. The third segment will evaluate the current statistical data from the incarceration systems to identify and prove disproportionate trends of black people in detention facilities. Eventually, the paper will discuss current policies that advance racially selective incarceration.
So What
Laws that target specific populations such as mandatory prison sentence for non-violent criminal crimes should be reviewed and possibly eliminated. The judicial system should regulate its policies to incorporate social-economic factors in its operations so as to ensure fair trials. The detention facilities should act as prisons and not punitive facilities. Eventually, every person should appreciate the role played by the American legal system to unfairly incarcerate the black population and support initiatives that seek equal treatment for all races by law.
