Discrimination according to the SAR, is to give an unequal treatment to a person or community for racial, religious, political, age, age, physical and mental condition, etc. It is important to publicize this definition since racial discrimination and immigrant people are present in one way or another in most societies, as well as in Chilean society, these discriminations occur above all in minority groupsthat are in vulnerability and are subject to discriminations.

Stefoni (2001) states that racism in Chile is not evident and open compared to other parts of the world, therefore, in Chile it is discriminated due to the roots of these behaviors in the members of society, Chileans see immigrantsWith inferiority and this leads to discriminatory behaviors towards them, it is important to mention that migration feels like a threat to the population in terms of the loss of Chilean national, cultural and ethnic identity.

The Chilean State has strived to create legal regulations that guarantee the fundamental rights of the immigrant population in Chile, therefore, the duty of the State is to ensure that discriminatory, xenophobic and violation of rights towards immigrants do not occur inNo sphere, however, these legal regulations have failed to guarantee the fundamental human rights of these minority groups, therefore the current problems cannot be eradicated. Although legal regulations have been created to protect and guarantee human rights, it is also true that creations of new laws are not enough for the current immigration reality in Chile, this is reflected in the fact that discrimination and continuous intolerance in societyChilean against the minority groups of the population, in this case the immigrant population.

The discriminatory behaviors of Chilean society towards the immigrant population reveals how racism is rooted and as Chileans see these minority groups as a threat towards the identity of the Chilean population, concluding that the members of theChilean society have no tolerance and see inferiority to immigrants, therefore it is proven that the discrimination suffered by immigrants has become a social problem. It is suggested that the State be responsible and manage to create legal regulations that guarantee the fundamental human rights of immigrants in Chilean society in discrimination.
