Personal Law and Ethics in Psychology

“Ethics is not a description of what people do;It is a prescription of what we should all do ”. 

In the course of life, people demonstrate the practice of ethics in a descriptive way without judging, considering that it is the most correct way, but not the human being must focus on the prescription, in this way we can judge our actions and act onProfessional life, thus in the performance of our career the objective would always be to do good by sticking to ethical principles and norms;This being the important reason to carry out a study on the law and ethics in psychology, as we know that ethics is important in all professions so that they develop in the best way for the good of humanity;Moreover, in the performance of psychology, understanding that when doing a bad ethical practice we will be immersed in judicial matters and destroy the integrity of the human being.

I also consider that the law must always be linked to ethics at all times and circumstances to glimpse and reach the goals drawn, since when working together between ethics and law, better results will be obtained both for the patient and for the professional, focusing usIn the human being as primary.

With these relevant ideas about the law and ethics, start detailing the issue of this investigation.

LEGAL PSYCHOLOGY AND PSYCHIATRY

Rapperport in (1982) defines "There are two different areas of contact between psychology, psychiatry and law" (Tarrago, 1996) "Here he speaks first about psychology and legal psychiatry, where the professional must assist those responsible for administering justice";second about "bad practice".

According to Diamond (1983) he says that there are two types of professional intervention;One is when the patient is being treated by a psychologist, he can be called to testify as an expert;The second is when the psychologist does not have any professional contact with a person, and the judge calls the professional to present a technical report. As psychologists we must know that we have participation in legal judgments, which also cover civil law.

The fundamental ethical problems that arise at the time of the practice of the psychologist are:

  1. Honesty and impartiality in the selection of the sources from which he prepares the information he will submit to the judge.
  2. The honesty and impartiality of the presentation or writing of the report.
  3. Confidentiality and expert work. When a psychologist or psychiatrist participates as a witness- at the request of the patient- nothing must be objected from the ethical point of view, because what the psychologist says before the judge would have been with the explicit authorization of the person involved. (Tarrago, 1996)

 

There is a different case from the ethical point of view is: the psychologist must act honestly and openly when preparing the information he will submit to the judge. 

Therapeutic privilege

It is a legal concept that applies in some countries, and that refers to the right that every psychologist or psychiatrist has not to communicate the patient’s information, guaranteeing not to reveal it so that no damage can be done. If the psychologist or psychiatrist will refuse to reveal the patient’s confidence, they should not be sanctioned under any circumstances, however we must explain that the term “secret of confession is not used as a legal concept in psychology, rather it would be the equivalent of the equivalent ofpriests in the Catholic Church ".  

We can also say that it is a particular benefit or advantage that a person can enjoy, attaching that it is a consent given by another person or by the law that guarantees the patient.

The bad psychological practice

It is the failure in the exercise of the suitability of a psychologist, within the bad practice we have: imprudence, impericia, and negligence.

  • Recklessness is the use of uncertain procedures giving doubtful results.
  • Impericia is when the professional is not trained or does not know a treatment to be used.
  • Negligence refers to not putting into practice the pattern of behavior of a professional such as not updating the treatments.

 

Knowing this and by falling or disrespecting any of these aforementioned aspects we are falling into a bad practice, when this happens we should recognize our error, thus demonstrating that we are good psychologists, that demonstrates and defines as a person and professional, within the practice of the psychologistThis always honesty and sincerity.

Conclusions

When doing this work I conclude that the joint work between law and ethics is indispensable, since having knowledge about the ethical principles that govern the law we can obtain effective performance based on the truth.

So the essence of the professional psychologist is the honesty that must be present in daily work. That every psychologist must train and update their knowledge for their personal and work growth, because the ignorance of the laws does not exempt from responsibilities.
