The Role of the U.S Supreme Court
The supreme court of the United States (U.S) has a vital role in the sates government system. The constitution gives them the authority to scrutinize, when essential, both the actions of the president and the Congress. However, they are more eager proclaim to the acts of the Congress as unlawful than the president’s actions. Therefore, in this paper, I will elaborate on the reason why the justices of the Supreme Court are seen to be more eager to proclaim the actions of Congress as unlawful than to declare that presidential actions were unconstitutional. Additionally, I will talk about the instances in the past when the supreme court’s justices have checked the presidential power.
The U.S Supreme Court gives the final judgment in all the laws that the Congress passes and, in some instances, it has been seen declaring the laws passed by the Congress unconstitutional. For example, in the case of Marbury vs. Madison in 1803. The major reason why the Supreme Court declares the Congress acts more unconstitutional as opposed to the president’s acts is that the judges are selected by the U.S president. The sitting president usually appoints the judges who are then vetted by the Senate. Since their appointment comes from the president, this limits them from declaring his actions unconstitutional.
However, there are some instances in the past when the Supreme Court has checked the presidential powers.

An epitome of such a case is on 2001 when President Bush treated some terrorist suspects who had been captured as enemy combatants prior to their access to lawyers or any legal rights (Purdum, 2004). The Supreme Court acted reminding the president that he was not above the state’s law limits and the prisoners were not beneath the law. It was not right for the president to prevent the aliens and citizens held from facing the courts as it violates the Americans governing creed and the division of power outlined by the constitution. It is the mandate of the president to take into consideration the verdict given by the Supreme Court regardless of incorrect he may consider it to be (Purdum, 2004).
In conclusion, it is the role of the Supreme Court to make sure that president, the Congress, and government officials exercise their powers within the set boundaries by the constitution.
