History of Criminology according to Francisco Bueno Arús

Introduction

Throughout this work, I will carry out an investigation into the life and work of Francisco Bueno Arús. He graduated from law in 1957, and two years later;In 1959, he managed to become part of the body of lawyers of the Ministry of Justice, through oppositions, during the time he worked in said public body, at the same time he was director of the Journal of Penitentiary Studies and director of the Legislative Collectionfrom Spain.

In 1978, he was appointed Head of the Technical and Legal Service of Penitentiary Affairs of the General Directorate of Penitentiary Institutions.

During the period in which he was part of the Editorial Commission of the General Penitentiary Organic Law and in which he presided over the working group to which the work of preparing the penitentiary regulations (which was approved by Royal Decree 1201/1981 of May 8), he had the opportunity to make some of his aspirations come true, among which were;Establish the true judicialization of the execution of criminal sentences, improve the Spanish penitentiary system to live up to the most developed countries, provide true content to the theory of penalty with the resocializer of the offender and offer the inmates opportunitiesTo start a new life away from crime.

Developing

Throughout his life, Francisco Bueno Arús wrote more than seventy articles in various legal magazines, participated as a co -author in the elaboration of thirteen works and was the author of eleven works, which focused around penitentiary law and criminal law;Some of him’s most important contributions are the following:

"The cancellation of criminal records": in this work, as the name implies, on the one hand, the study of the cancellation of the criminal records (which was a subject little studied by scientific doctrine was addressed, compared to the theory, compared to the theory with the theoryof the crime or the determination and execution of the penalties), and on the other hand, an analysis of the historical background and the content of the registration of Penados y Rebdes, and of the legal cancellation requirements, the procedures established forThis, its effects and the elimination of the criminal record.

"The science of criminal law: a model of legal insecurity": in this work, which has a more reflective character than essay, a critical reflection was made on the fundamental principles and categories of criminal law, and conclusion was concludedThat none of them, for two centuries of elaboration of works of the scientific doctrine, have provided the jurists with the essential security in knowledge or the desirable coherence in the creation and application of the norms. It concludes that criminal law should not end up being a "science" that is imposed on public authorities and justifies the existence of jurists, but that criminal law must be an instrument at the service of men, regardless of any other ideology.

‘Notions of crime prevention and treatment of crime’: in this work the challenge of providing the elementary ideas in a matter of crime prevention, while systematizing a subject that develops in this book for the first time, is faced in this work, at the same time that develops in this book for the first time,trying to avoid repetitions with the content of other branches of criminology, but without rejectPenitentiary treatment and criminal law.

"Terrorism or the never ending story": in this article, written by Francisco Bueno Arús when he was an emeritus professor of criminal law at the University Pontifica Comillas, a reflection is made about the following;The negative consequences that leads to the lack of a definition by the scientific doctrine of the concept of "terrorism", of how criminal law (especially in this issue) is very influenced by politics (because governments, depending on ideology, they will consider terrorism to the movements that defend ideas contrary to their own), of the configuration of the most appropriate legal-national regime for terrorists and finally, if terrorism must be considered exclusively a political problem or not.

"The legal dimension of the prison sentence": in this article, written by Francisco Bueno Arús when he was a ordinary professor of Criminal Law at the Pontifical University Comillas, the following is spoken;The nature of the penalty of legal institution in the social and democratic states of law, the values of security, justice and freedom that must always have with respect to the Constitution, the principles of proportionality minimum intervention, legality, and guilt that must be complied with,Civil liability derived from crime, the legal-national relationship and disciplinary responsibility, and finally, of the causes of extinction of the legal-population relationship.

"Shadows and lagoons of Spanish criminal policy around the criminal responsibility of minors": this article written by Francisco Bueno Arús when he was a professor emeritus at the University Pontifica Comillas, aims to demonstrate that the reforms of Organic Law 5/2000,of January 12, regulating the criminal responsibility of minors, they are unconstitutional (they are contrary to the provisions of the Constitution about the preventive end of penalties), they are illegal (since they consider “criminal” the responsibility of some authors derived fromThe infraction of criminal laws when they are minors are imputable and immoral (because they focus the sense of citizen insecurity of society over minors without taking into account the media through which minors are witnesses ofideas and examples of violence, a situation that no one tries to stop, but is perpetuated and increased)
