LedeThroughout the American history, relations of race have explicitly been in representation as being binary. The African Americans, Hispanics, and the Asian Americans have often been overlooked. Consequently, affirmative action has always been considered as a perfect tool for rectifying the menace of racial inequalities and discrimination throughout the country’s past years. In recent times, the Asian Americans have been primary participants in the debate concerning affirmative action. However, the present scholarships have simplistically painted the picture of affirmative action on the Asian-Americans. Scholars have identified adverse effect rather than affirmative action as being the cause of the discrimination against the Asian-Americans during school admissions.
Thesis
The utilization of race is an additional factor for the minor races though it has turned out to be a disadvantage to the Asian-American scholars demonstrating scholastic brilliance. The students often find their acquirements unnoticed due to their ethnic background. Affirmative action was developed to help in preventing prejudice against minority races in the United States. However, the Asian Americans have been deprived of their fair share of acquiring admissions into college. Apart from the fact that these policies were enacted to help the disadvantaged, it would be fair if they are based on the disadvantage issue and not a racial issue.

Recently, there have been allegations of Harvard University discriminating against the Asians during students’ admission.
Argument
Based on the data from an influential book in which two sociologists from Princeton, Thomas, and Radford, revealed how high a student had to score on the SATs to get an equal chance to be admitted into college, given the student is from another racial background. The study, however, led to wide arguments that affirmative action is a misguided policy meant to help the Hispanics and Blacks, while the white and the Asian people were unfairly penalized.

The high-profile federal lawsuit that alleges the university’s discrimination against the Asian American students could present the Supreme Court with the opportunity of striking down affirmative action. The lawsuit filed claims that the university has been illegally discriminating against the Asian applicants by limiting their numbers of admission annually. However, the Justice Department argued that the university does not effectively explain how the race issue has been a factor in student admissions. This was a clear indication that the university has gone beyond what is required of them by the law. Additionally, universities that factor race into their admissions will face it rough as the President Trump’s administration has stood still against the issue. The administration, in its filing with the Supreme Court, argued that Harvard University should be denied the request to dismiss the case in trial.

These complaints have led to internal investigations regarding the admission practices in several schools. As per Harvard’s case, SFFA claims to have evidence proving the university has been limiting the number of the Asian Americans illegally and deliberately and that the university has also been underscoring the Asian applicants. The Justice Department issued a confirmation of examinations of the claims of the racial discrimination against the Asian-American scholars during the admission process. This is a very significant development. If by any chance the Justice Department follows through what the lawyers will find at Harvard is unconstitutional and unfair process restricting the number of the Asian-American admissions. This should be a wake-up call to all Americans.

Harvard University has a very long and sad history of applying holistic admission process in discriminating the minority races. In the past century, the university’s leadership believed it had many Jew scholars since almost a quarter of all the freshmen were Jewish. In a letter written by the then Harvard president, Abbott Lawrence, the increased number of Jewish admissions into the university would ruin the university. To solve what they termed as the “Jewish invasion,” the university embraced the holistic admission system, and within a year, the Jewish enrollment was decimated. Today, it is the same story, but it is now the Asian-American scholars and not the Jewish scholars as it was before. To try end this problem, SFFA has sued Harvard University in the federal court.

The above arguments were based on the currently ongoing case of Harvard University, and all points were conclusively withdrawn from data records, news, and publications which are open to the general public. Any critics as per my arguments are allowed, but should entirely be correctly addressed by accurate knowledge of the ongoing case with Harvard University.
Conclusion
Throughout American history, relations of race have explicitly been represented as being binary. The African Americans, Hispanics, and the Asian Americans have often been overlooked. Regardless of whatever is happening with the Harvard case or the Supreme Court, the institutions of higher education must work towards ensuring that all students have an equitable chance of attending to any university, regardless of the racial background. Many people hope that the Justice Department agrees and act by the constitution.
