EDUCATION AS A FUNDAMENTAL RIGHT

Instruction is one of the fundamental rights for a society since to guarantee other rights such as civilians, commercial, formative, among others, a minimum of instruction is requested. The United States Rights Charter does not speak specifically about the right to instruction, but if it talks about entrusting the states that have not been illicit by the Constitution and these domains are expressed in the Esea Law.

On December 10, 2015, the law triumphs (ESSA) was signed, by the then President Obama, the same endorse. The ESSA Law somehow compromises each State to monitor the benefits of students and level schools with low levels of studies and thus establish skills to improve school communities with problems. ESSA is a re -authorized adaptation of the ESEA Law. According to President Lyndon Baines Johnson, who signed ESAA law, total pedagogical relevance would correspond to be our first national end.

Public and private schools in Puerto Rico remain covered under the ESSA law. According to Section 1117 of the ESSA Law, it demands that the Department of Education supplies the eligible students of private schools, benefits such as those provided to those of public schools on the island. The ESSA law guarantees that those students of private academies that deserve it take egalitarian services with those of public schools such as pedagogical materials and therapies, among other services. At the level of poverty and unemployment in Puerto Rico, you cannot blame for the failure of pedagogical backgrounds, on the other hand, if you can be attributed to the corrupt administration of these pedagogical opportunities.
