The process of health policymaking entails several complex ethical and some social questions. However, the primary goal of health policymaking is to promote the health of citizens and the entire community. From different perception, the united state is a diverse and a more complex society that requires particular attention on health matters. In fact, several individuals and groups usually “weigh in” some of the importance of policy issues concerning health. Due to the extensive range of America’s on health policy-making organs, there is quite a significant challenge to the health department (Longest, 2016). For instance, the bodies are unable to provide a comprehensive and systematic process towards the formulation of the health policy. The paper explores the entire health making process and some of the potential issues behind the operation. Also, the article explains matters hindering the implementation of patient safeguard and Affordable Care Act. Besides, it illustrates the role court’s role in health policymaking process.
Healthcare policymaking process in the United States
There is a well-considered criterion that ensures a complete and efficient method of policymaking in healthcare. Firstly, the health practitioner should evaluate and examine the entire interest of the public to health. It entails the question of whether the proposed policy is appropriate in seeking the overall objective of achieving compelling health.

Besides, the policymaker needs to scale down and define the purpose of the plan to the healthcare setting (Longest, 2016).Secondly, the policymaker should narrowly examine the entire effectiveness of the policy. For instance, he/she should collect appropriate data that is significant in the logical analysis of the efficacy of the plan.
On the other hand, there is a necessity of examining whether there is an appropriate target of the proposed policy. For example, proper analysis to test if the system is tailored to address the general health challenges. Additionally, the process should include identification of possible burdens regarding human rights. For instance, observing there is no interference with individual rights such as liberty, privacy, and nondiscrimination. Finally, there is an examination of the restrictive alternative of the policy. In fact, the policymaker should aim at assessing if there is an appropriate achievement of the health objective. Besides, the above step guides the policymaker in considering alternatives that may suitably suit both the individual and society health interests (Biomedicine et al., 2018).
Potential issues that could affect implementation of the Patient Protection and Affordable Care Act
The most intriguing problems appear from nuanced opportunities that manifest from recent coverage and regulatory environment where the health policymaking takes place. For example, there is an issue concerning the expansion of roles of public health. For instance, there are significant complications on the development of coverage on clinical protection services in for both private and public insurance. Secondly, it is unclear whether federal health should take a big responsibility in providing various clinical protection services in the realisation of the access.
More so, there is an issue regarding how the health agencies should partner health professions to increase the demand for care. Furthermore, there is a challenge regarding how the insures, public health agencies and employers perform in the translation of coverage reforms into improvements of better health services (Amar, 2017).
Potential Issues Related to Healthcare policymaking process in the United States
The method of policymaking in health setting entails several potential problems. For example, there is an issue on new public laws as well as the amendments to the already existing laws. In fact, all changes concerning health are initiated through relations of many health-related challenges. Besides, there is lack of adequate provision of possible solutions as well as the changing political situations that concern the problem. In many instances, the diverse political interests tend to overlay several issues about health policymaking process together with their possible solutions. For example, from the aspect of agent setting, it is evident that there is a recurrent of a particular problem from one step to the next level.
The Role of Courts in health Policymaking
The court in many cases ensures precise control on cost containment in respect to the formulation of health care policies. They are responsible for ruling controlled care defendants more than individual’s plaintiffs. On the other hand, they make considerations on policy objectives whether they correlate to the expected outcome (Longest, 2016). In general, courts are likely to rule for plaintiff especially when there is observation fairness in the outcome of the case. From the study, courts more so emerge to consider policy trade-offs. In fact, they refrain from policy formulation by avoiding second-guessing the aspect t on public policies that favour cost containment.
In conclusion, the process of health policymaking aims at improving the health of an individual and the society as a whole. However, the process contains various potential issues that need full attention. In fact, such problems tend to hinder the implementations of Patient Protection and Affordable Care Act. On the other hand, for effective implementation of appropriate health policymaking, there is a necessity for court interventions. For example, the court seeks to significantly consider the objective of the entire process and examine whether it provides better health care services to the society.
