Social Security Principles in the Nicaraguan Legal Order

According to article number two (2) of Social Security Law Law No. 539 establishes that they will be governed by the following principles:

Arto. two.- Social Security will be extended in the population segments not covered in successive, gradual and progressive stages, covering the contingencies of the branches of illness, maternity, disability, old age, death and professional risks, and developing the social services necessary for the well -being ofThe insured and their beneficiaries.

To do this, it will be based on the following principles:

  • Universality: All the inhabitants of the country have the right to benefits, without mattersing the class of work activity, professional or economic activity. The field of application must tend to the coverage of the entire working population.
  • Integrality: The different states of necessity according to the contingencies that cause them will be covered progressively, making effective the right to multiform protection against the most extensive possible number of social contingencies, according to social consciousness and the feasibility criteria.
  • Equality: Protected subjects will have equal treatment in equal circumstances.
  • Solidarity: mutual help between people, generations, economic sectors and communities, whereby the strongest protects the weakest.
  • Management and Immediate Unit: The organization of the system must tend to a common administration and central conduction, but its execution can be decentralized.

Which as in the first place the principle of universality, which establishes that all people must at least participate, regardless of their labor status, since it is a right that they are in this social security system.

As second is that of integrality, which establishes that the benefits that are accrued by the people who belong to this social security system must be consistent with the need, bone that have to be evolved little by little and not stay, forthus go covering in some ways the social need that may appear.

In fourth place we have the principle of solidarity which should be noted that for us it is the backbone of social security, since it is understood as that all subjects, the entire population has to support, contribute to the economy of the financing of the financing ofThis system, in the aspect that young people who are starting to work, since in itself the weakest population is that of the elderly, and the fort with more energy is young because at this beginning it is intended to protect thepatients in front of the healthy, of those who still live from those who died, those who left a widowhood or orphanage pension etc.. Since without young people, this system would have no reason to be, one harvest in itself for one to already take those fruits.

And as a last principle it is established that it is the management and immediacy unit, which has to do with the way to function in a coordinated way so that they execute the benefits or benefits that this Social Security system establishes, taking into account theother principles that govern our social security system.
