To get to the concept of virtual trade establishment, we want to bring to this essay first, relationship of concepts already constituted as: Establishment of Commerce, Orange Economy, Industrial Revolution (Fourth), among others. In addition, considering that the Internet, that network that surrounds us, is founding on the need for this writing.

First, the Commercial Code makes us mention that the trade establishment is a good, but does not detail what kind of good, that is, said code assembles a concept with characteristics so that the Colombian on foot or connoisseurof the law understand that there will be goods that are called trade establishments and that must comply with elements such as statutes (law or obligations), representative (s), a name and transferable. But, when we refer to “what” type of good, we go to civil law goods understanding that there are movable and immovable property, and that we could irresponsibly say that, something virtual is something movable. Taking into account the above, the commercial law, in other words, the decree established by the Commercial Code is short by not considering that there is no regulation for a virtual trade establishment.

Then, we want to link to this writing the concept or idea of orange economy, since it is understood as the creative economy. The basis of that economy is intellectual property (of which little has been discussed), our culture, talent, ingenuity, everything that links creativity and a developer tool today;connectivity to networks, to the electronic field or virtual world.

And we mention the last connectivity, not because it is less important, quite the opposite, because in recent years it has been constantly growth, growth through the internet, of that virtual world that we are not alien.

On the other hand, it is pertinent to bring up the industrial revolution, considering and remembering that the first one generated an important step in the economy based on agriculture and trade towards an urban economy with a contribution of steam machines. After this mechanized trade, the story that the economy made a leap to the use of electricity that allowed a technification of trades. All of the above has allowed humanity to change and with it what surrounds it. Therefore, we refer then, in this writing the fourth industrial revolution, revolution that we are not going to escape.

To talk about the fourth industrial revolution we go to a brief historical tour of the previous ones, which allow us to conclude what a story refers from cultural materialism. History tells us that all technological advances, in the long run, is positive. What is unpublished of these times is the speed of events. To date, most governments, local economies and, with them, citizens, it seems that they are losing the race against machines. Thus, this revolution dates back to the use of culture and advanceHe is an entrepreneur, who thinks, designs and manufactures;From a very romantic side of the matter, it would be in this century, a rebirth of man.

But as a society we are prepared for that? What is clear, is that we are on the edge of a technological revolution that will fundamentally modify the way we live, work and interact. These changes agree that there will be an impact on geopolitical security and ethical frameworks.

However, taking into account the above, aspects of virtual trade establishments have been regulated legally, for example, art 91 of Law 663 of 2000 provides ” all web pages and internet sites of Colombian origin that operateOn the Internet and whose economic activity is commercial, financial or of services, they must register in the Mercantile Registry and provide the DIAN, the information of economic transactions in the terms that this entity requires it.”(2000) With that approach, the opening to the virtual space is given as a company, which is no longer a good said from the Commercial Code, but rather, rethinking of the space or labor office.

In the words of Kalakota and Whinston against electronic commerce, it is a modern methodology to do business that take into account the needs of organizations, merchants and customers in order to reduce costs. This idea, agrees with the World Commercial Organization meanwhile, what is sought with the economy through the Internet is to have goods and services, market the needs of the human being.

Finally, it is to think that the establishment of virtual trade is a change from the physical to a world and/or “imaginary and intangible” space that is real, therefore, there are partners, suppliers, transactions, customers and products immersed in the network. This is why we think there are many benefits on this issue, such as the reduction of costs of an office or commercial premises, even labor. The challenge is to take advantage of the network to optimize the economy through projects such as the orange economy.

In conclusion, the virtual trade establishment is nothing more than the existence of advancing in the economy in an intangible space.
